Panel: UK company’s name isn’t so special
A company that invoked the UK's domain dispute system just had its own filing declared the abuse.
Especial Ltd claimed the right to especial.co.uk and a sister domain, arguing its company name deserved priority. A Nominet DRS panelist reached a different verdict: the complaint itself was brought in bad faith.
Reverse hijacking findings are the quiet teeth of dispute systems. They tell trademark owners that the process is not a free seizure tool — bring a weak claim and the record will say so.
The panelist saw through the corporate name argument. A company's name being 'special' to its own business does not make an existing domain registration illegitimate.
For domain holders, this is a useful precedent: a well-documented, good-faith registration can survive not just the complaint but also turn the tables on the complainant's conduct.
